Shape Events, Owner Claudia Peters, Version number 2016-03-12

 

§ 1 General Information

The business relationship between Shape Events, owner Claudia Peters (hereinafter referred to as organiser) and the participants of the tours (hereinafter referred to as the customer) shall be exclusively governed by the following Generall Terms and Conditions in their valid version at the time of contract conclusion.

Deviating Terms and Conditions of the customer which conflict or differ from these Terms and Conditions will not be recognised, unless the organizer agrees  thereto explicitly in writing.

 

 

§ 2  Eligibility Requirements

(1) The organizer is entitled to allow the tour participation of the customer on condition of the fulfillment of special conditions (such as the presence of certain manoeuvering skills and good riding control). In addition, customers must be 18 years or over and be legally competent.

(2) The prerequisite for participation in a tour is – unless otherwise specified - a technical perfect bicycle as well as ample breakdown equipment (including spare replacement inner tube, repair kit, air pump, tools etc). It is not the task or obligation of the organiser to provide the customer with technical support in the event of a breakdown. If a customer is unable to continue the tour after a breakdown,any necessary return transport shall be carried out at customer's own risk and expense.

 

§ 3 Conclusion of contract

By a written or oral notification the customer bindingly offers to close a contract.  Application  by the customer is also effective for all the participants included in the application. The customer bindingly accepts the General Terms and Conditions of Shape Events - also in the name of and on behalf of the additional participants.

The contract is concluded when the organiser confirms registration by email, by fax or verbally.

 

§ 4 Prices

Please see the  price agreed upon in the written confirmation of your registration.

 

§ 5 Payment

Payments take place depending on the agreement (via transfer in advance or cash at the end of the tour, if possible match exactly).


§ 6 Implementation

(1) The minimum number of participants is according to the tour selection. The organiser reserves the right to cancel a tour if the minimum number of participants at the discretion of the organiser has not been reached.

(2) The maximum group size  is 14 persons; larger groups can be organised after consultation with the organiser.

(3) If registered customers do not appear  at the agreed time and location, there is no guarantee of participation.

 

§ 7 Benefits and Changes in service

(1) The scope of contractual services arise from the  service description or confirmation of the organiser in this regard.

(2) Specific requirements or subsidiary agreements are only part of the contract if confirmed in writing and unconditionally by the organiser.

(3) The sights and places of interest as indicated in the itinerary are mostly and mainly milestones.   The organiser expects you to herewith agree to evasive maneuvers around certain places of interest at times if required or deemed necessary by the organiser without any financial deductions.  Any deviations from the described tours for organisational reasons are possible but such deviations do not harm nature and content of the tour and shall neither justify the customer to withhold the agreed upon amount of the contract nor to receive a deduction of any partial amount from the agreed upon amount of the contract.

(4) Should the the organiser be responsible for the absence of a service, the organiser may replace this with an equivalent service at his own discretion. The organiser is obliged to inform the customer of this. The organiser will offer the customer the option to rebook or to withdraw from the contract free of charge.

 

§ 8 Right of Withdrawal and Termination

(1) The organiser may terminate the contract with the customer without a period of notice if the customer continues to disrupt a tour or if the customer behaves adversely after being asked to refrain from this.

(2) If the organizer terminates the contract according to § 8 par. 1 of the general terms and conditions the customer is not entitled to a refund of the participation fee.

(3) The customer is entitled to revoke his statement of intent for entering into a contract without indicating any reasons within two weeks in written form to the address of the organiser. Punctual sending within Germany shall be sufficient for observance of the deadline of two weeks. In case of the effective cancellation the organiser will refund the price in full.

(4) A registered customer may withdrawat any time from the tour.before participating in the event or tour. Determinative is the receipt of written notice of termination by the organiser.In this instance, the organiser is entitled to demand the following compensation:

- up to 4 days prior to the tour: no cancellation fee,

- 3 days prior to the tour: 100 % of the price.

 

§ 9 Liability and limitation of liability

(1) The organiser is liable within the framework of care for a meticulous preparation of the tour.

(2) The participation in all of the events is at your own risk. The organiser cannot be held responibe for any damages, accidents or the like. On site each participant needs to sign a disclaimer.

(3) Compliance with the rules of the road is the responsibility of the customer.

(4) The information on the physical requirements and duration of the tours is provided according to the best of the organiser’s knowledge, but without any guarantee of correctness, since such data is subject to not only subjective assessments but also to external influences, such as weather conditions. The customer alone is responsible for ensuring to meet the physical and health requirements of the event.

(5) In case the event does not take place for reasons beyond the control of the organiser (e.g. natural disasters, power failure, accident, strike etc) the organiser reserves the right to withdraw from the contract before or during the event. In the latter case the customer will pay the pro-rata event price.

(6) The organiser is not liable for any purchased services and other service providers explicitly marked as external subcontracted services.  The organiser does not accept any liability in the event of theft.

 

§ 10 Ineffectiviness of individual provisions

The invalidity of individual provisions of the contract does not lead to the invalidity of the contract as a whole.

 

§ 11 Place of fulfillment and place of jurisdiction

The place of performance and the sole place of jurisdiction shall be Lübeck, Germany.
